2. Provision of the Website

When the website is accessed, the following data is processed for technical reasons and stored in server log files:

Purpose and legal basis:
The processing is carried out to provide the website and to ensure the security, stability, and availability of the systems used. The legal basis is Article 6(1)(f) GDPR. The legitimate interest lies in the secure and reliable operation of the website and in the detection and prevention of attacks, misuse, and technical disruptions.

Recipients:
The website is operated on our own servers in Germany and/or with the involvement of NETWAYS Managed Services GmbH, Deutschherrnstr. 15-19, 90429 Nuremberg, Germany. ScaleUp Technologies GmbH & Co. KG, Süderstraße 198, 20537 Hamburg, Germany, may be used as a data center or infrastructure provider. To the extent that these service providers receive access to personal data in the course of providing their services, processing is carried out to the necessary extent as processing on behalf of the controller pursuant to Article 28 GDPR.

Storage period:
Server log data, including full IP addresses, is stored for a maximum of three months and subsequently deleted. In the event of specific security incidents, the log data required for this purpose may be stored for longer, until the investigation has been completed or until legal claims have been asserted, exercised, or defended.

Necessity of provision:
The transmission of connection data required for network communication is technically necessary to deliver the website. There is no legal or contractual obligation to use the website.

3. Communication by Email

When you contact us by email, we process the data transmitted with the message, in particular the sender’s address, the content of the message, contact details contained therein, and technical email metadata.

Purpose and legal basis:
The processing is carried out to handle and respond to the message. Where the communication serves to initiate or perform a contract, the legal basis is Article 6(1)(b) GDPR. Otherwise, processing is based on Article 6(1)(f) GDPR; the legitimate interest lies in handling business and other communications addressed to us.

Where retention is required under commercial or tax law provisions, further processing is carried out on the basis of Article 6(1)(c) GDPR in conjunction with the relevant statutory retention obligations, in particular Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO).

Recipients:
The email servers are operated on our own servers in Germany. To the extent that the technical infrastructure is operated in a data center provided by ScaleUp Technologies GmbH & Co. KG and the provider receives access to personal data in the course of providing its services, processing is carried out to the necessary extent as processing on behalf of the controller pursuant to Article 28 GDPR.

Storage period:
Email communications that are not subject to retention obligations are deleted as soon as they are no longer required for the respective communication purpose and no other legal basis exists for further storage. Commercial and business correspondence is generally retained for six years where retention is required by law, and accounting documents are generally retained for eight years. The statutory periods generally begin at the end of the calendar year in which the respective document was created, received, or sent.

Necessity of provision:
Contacting us by email is voluntary. Without the information required to process an inquiry, it may not be possible to respond to it or to initiate or perform a desired contractual relationship.

4. Right to Lodge a Complaint with a Supervisory Authority

Pursuant to Article 77 GDPR, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data infringes the GDPR.
